Buyer: The person whose name, contact and delivery details are provided in the order or checkout/manual inquiry form.

2. Subject

This agreement governs the sale, delivery, payment/collection process, withdrawal right and rights/obligations of the parties regarding products ordered electronically through the Kaktüs Doktoru website. When PayTR is not active, manual inquiries are treated as preorder/contact requests until payment and delivery details are separately confirmed. It is prepared within the framework of Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

3. Product, Price and Delivery Information

The product type, quantity, unit price, total amount, sales price including taxes, delivery details and any shipping/additional costs consist of the information shown on the order or checkout screen. Live plants may reasonably vary in image, size, color, form and seasonal appearance due to their natural characteristics.

4. Payment and Collection

When PayTR is active, payment transactions are processed through PayTR's secure payment infrastructure. For Turkey-based transactions, the card statement or bank record may show references related to Sinan Kara and/or PayTR. If PayTR is not active, checkout does not initiate online payment; your inquiry is received manually. At this stage, a final sale is not deemed completed, and payment/delivery details are shared separately by our team.

Card details are not stored in Kaktüs Doktoru systems.

5. Delivery

The Seller is obliged to send the product subject to the agreement to the Buyer's delivery address in accordance with the order details and without exceeding statutory periods. Delivery time may vary depending on stock status, live plant preparation, seasonal conditions, public holidays, courier workload and delivery region.

The Buyer is responsible for the accuracy of delivery address and contact information. The Buyer may be responsible for delays and additional costs arising from incorrect or incomplete address/contact information.

6. Right of Withdrawal

As a rule, the Buyer has the right of withdrawal within 14 days from delivery. However, the exceptions listed in the Regulation on Distance Contracts are reserved.

Live plants may be considered products that deteriorate quickly or may be unsuitable for return by nature because they are directly affected by transport, temperature, dehydration, care conditions and passage of time. The right of withdrawal may also be unavailable for products specially prepared, personalized, reserved, potted or packaged according to the Buyer's request.

The right of withdrawal may also be limited for complementary products that are unsuitable for return for health or hygiene reasons, whose packaging has been opened or whose resale suitability has been impaired.

7. Defective, Damaged, Incorrect or Missing Product

Exceptions to the right of withdrawal do not eliminate claims regarding defective products or incorrect/missing delivery. If there is delivery damage, incorrect product or missing shipment, the Buyer must contact [email protected] on the delivery day, preferably with photo/video evidence while opening the package.

If there is crushing, breakage, wetness or serious external damage on the package at delivery, the Buyer is advised to have the courier prepare a damage report and, where possible, refuse delivery. Reports and visual records speed up the review process.

8. Returns and Refunds

For accepted returns, the product must be packaged securely and sent to the address notified by the Seller. Refunds are made within statutory periods, depending on the payment method and bank/payment provider processes. Posting times caused by banks or payment providers are outside the Seller's control.

9. Dispute Resolution

For disputes arising from this agreement, Consumer Arbitration Committees are competent within the monetary limits announced by the Ministry of Trade; Consumer Courts are competent for disputes exceeding those limits.

10. Effectiveness

By confirming an order or submitting the checkout/manual inquiry form, the Buyer declares that they have read and accepted the preliminary information, Terms of Use, Privacy Policy, Return Policy and this Distance Selling Agreement.
