1. General Terms
This website is operated under the Kaktüs Doktoru brand. By visiting the site, creating an account, creating a cart, submitting a checkout/manual inquiry form or purchasing a product, you are deemed to accept these Terms of Use.
2. Payment and Collection Authority
For purchases made through Kaktüs Doktoru, payment security and collection transactions may be carried out through authorized payment infrastructures. For Turkey-based transactions, depending on the payment method used, your card statement or bank record may show references related to Sinan Kara and/or the PayTR infrastructure. These references indicate the technical execution of financial collection and do not change the fact that the product and service are offered under the Kaktüs Doktoru brand.
Unless PayTR is active, checkout does not initiate real online payment; your cart, contact and delivery details are forwarded to the team as a manual inquiry. This step does not by itself mean a final sale or collection; payment and delivery details are shared separately with you.
3. Product Information and Stock
Product descriptions, plant sizes, images, care notes, stock and price information are prepared with care. Live plants are natural products; color, form, spines, body, roots, flowering, scars and size may reasonably differ from the sample image. The product subject to an order is evaluated according to the stock, price and product information at the time of order.
4. Botanical and Care Content
The plant dictionary, care notes and product content are for general information only. They do not create a guarantee of care results, growth, flowering, disease recovery or product performance. Plant development may vary depending on climate, light, watering, soil, pot, shipping, season and care conditions.
5. Live Plants, Delivery and Risk
Live plants may be affected during transport by temperature, dehydration, impact, package opening time and delivery conditions. Kaktüs Doktoru takes care to package products securely; however, if breakage, crushing, spilling or serious damage is noticed upon delivery, you must contact us on the delivery day with photos/video.
6. Withdrawal Right and Return Exceptions
Live plants and products that may deteriorate quickly, lose viability or become unsuitable for resale by their nature may be subject to statutory exceptions to the right of withdrawal. Claims relating to defective, incorrect or missing products are evaluated separately from these exceptions. The Return Policy and Distance Selling Agreement apply to the detailed process.
7. User Obligations
Users must provide accurate contact and delivery information, protect account security, avoid unlawful or abusive use of the site, and refrain from fake orders or unauthorized access attempts. Kaktüs Doktoru may restrict an account, order or access in case of misuse.
8. Changes
Kaktüs Doktoru reserves the right to update products, prices, campaigns, content, services and these terms in accordance with applicable law. The current text takes effect when published on the site.
9. Governing Law
These terms are governed by the laws of the Republic of Turkey. For consumer transactions, Consumer Arbitration Committees and Consumer Courts are competent within the monetary limits and procedures set by applicable legislation.
